Online Attackers Called Us ‘Canada’s Madoff,’ Lawsuit Alleges

Secret Dropbox folders, a negative Twitter campaign, and an exclusive dinner for short-selling “conspirators” are all tactics alleged by Canadian private equity firm Catalyst Capital Group against rival firm West Face Capital and a slew of other defendants, according to the latest filing in a long-running legal campaign.

Catalyst’s remaining litigation against West Face involves two claims. The first claim was filed in June 2015 and alleges that West Face defamed Callidus Capital, a public company controlled by investment funds managed by Catalyst, by making defamatory statements between November 2014 and March 2015 regarding the financial prospects of Callidus. Neither Catalyst nor Callidus has engaged in meaningful steps to advance that litigation since at least February 2017. Catalyst Capital Group Inc. has launched a lawsuit against Anson Group Canada, a privately held asset manager with operations in Canada and Texas, and Toronto-based private equity firm West Face Capital Inc., accusing them of participating in a “manipulative ‘short and distort’ campaign.”
The alleged target was publicly traded Catalyst subsidiary Callidus Capital Corp., claims the lawsuit, which dubs the Anson, West Face and several associated and unrelated individuals as “Wolfpack Conspirators.”

West Face Capital Inc. today issued the following statement following the procedural ruling today by the Ontario Court of Appeal in the lawsuit by Callidus Capital Corporation and The Catalyst Capital Group Inc. for alleged defamation.
West Face notes that this appeal decision concerns only a motion about the form and content of the plaintiff’s pleadings at the very outset of this case, and does not concern the merits of allegations by Callidus and Catalyst, let alone the propriety of their business practices or public disclosures.
